Terms of Use

1. Acceptance of Terms

By downloading, installing, or using PixelForge ("the Application"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not install or use the Application.

These Terms apply to PixelForge, developed and distributed by Refora Technologies ("we", "us", "our"). These Terms may be updated periodically; continued use of the Application after changes constitutes acceptance of the updated Terms.

2. License & Permitted Use

PixelForge is provided free of charge. We grant you a personal, non-exclusive, non-transferable, revocable license to:

• Download and install PixelForge on Windows computers you own or control
• Use PixelForge for personal or commercial image processing tasks
• Share the official installer file or a link to the official download page with others

PixelForge itself is closed-source proprietary software. The open-source components it includes (upscayl-ncnn, caesium-clt, upscayl-custom-models) are distributed under their respective licenses (AGPL-3.0, GPL-3.0, MIT), copies of which are included in the installer.

3. Restrictions

You may not:

• Reverse-engineer, decompile, or disassemble the proprietary portions of PixelForge
• Redistribute modified versions of the application under the PixelForge name or brand
• Use PixelForge to process images you do not have legal rights to process or distribute
• Remove or alter copyright notices, license texts, or attribution statements bundled with the Application
• Sell or commercially resell the Application itself (you may use the Application commercially; you may not sell the app)

4. Open Source Components

PixelForge includes the following open-source components. Their use is governed by their respective licenses, which are included in full in the installer under the Licenses directory:

• upscayl-ncnn — licensed under AGPL-3.0. Source: github.com/upscayl/upscayl-ncnn
• upscayl-custom-models — licensed under MIT. Source: github.com/upscayl/upscayl-custom-models
• caesium-clt — licensed under GPL-3.0. Source: github.com/Lymphatus/caesium-clt
• Electron — licensed under MIT. Source: github.com/electron/electron

The AGPL-3.0 and GPL-3.0 licenses require that the source code of those specific components remain open. PixelForge complies with these requirements by directing users to the upstream repositories listed above. The proprietary automation code of PixelForge is separate from these components.

5. Disclaimer of Warranties

We make no warranties regarding:

• The accuracy, reliability, or completeness of the Application's output
• The Application's fitness for any particular purpose
• That the Application will operate without interruption or without errors
• Compatibility with any specific hardware, GPU, or Windows version beyond what is documented

You use the Application at your own risk. We strongly recommend maintaining backups of your original images before processing.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Refora Technologies and its contributors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, files, or images resulting from use of the Application
• Damage to hardware, including GPU or storage devices
• Business interruption or loss of profits

These limitations apply regardless of the legal theory under which damages are claimed, even if we have been advised of the possibility of such damages.

7. Updates & Changes

We reserve the right to update PixelForge and these Terms at any time. New versions of the Application are distributed via GitHub Releases. You are not obligated to update, but older versions may not receive security attention.

Changes to these Terms will be reflected by updating the "Last updated" date at the top of this page. Material changes will be noted in the GitHub Releases changelog.
